These terms and conditions ("Terms") are between you and SO-SURE. SO-SURE is a trading name of Open Insurance Services UK Limited (Company number 9365669). In these Terms, ‘we’, ‘us’ or ‘our’ means Open Insurance Services UK Limited.

These Terms cover the services we provide, including the arrangement and administration of insurance products as set out in ‘What we do’ below ("Services").They also cover your use of the wearesosure.com website ("Website"), including our Support Centre ("Support Centre").

By using the Website or our Support Centre, or by purchasing a policy through us, you agree to these Terms. Please read them carefully.

About us

Open Insurance Services UK Limited is an insurance intermediary, authorised and regulated by the Financial Conduct Authority under reference number 988625. You can confirm this at www.fca.org.uk/register.

What we do

We arrange and administer insurance policies on behalf of various insurers.

Arranging your insurance policy means that we set up your insurance contract with the insurers and we collect your payment on behalf of the insurer. We give you the information you need and ask questions to help you make the decision about whether the product and coverage is suitable for your needs, but we don’t give any advice about which product is best for you.

Administering your policy means that we support you with questions about the products or your policy, help you to make changes to your policy, and handle any complaints. We also work with carefully chosen claims partners to handle your claims.

Who underwriters the policies

We work with a number of different insurers. Your policy is underwritten by the insurer named in your Policy Schedule.

Each insurer has entered into an agreement with us to allow us to arrange and administer insurance policies on their behalf.

By purchasing a policy through us, you give us consent to re-broke your policy at renewal time. This means that the underwriter of your policy may change on your renewal. Any changes would be notified to you in your renewal documentation.

Our remuneration including fees

We are paid a commission from the insurers who underwrite your insurance product. The amount of commission varies and is included in your premium.

We also receive a fee from the insurer to cover the costs of dealing with claims. This fee is passed in whole or in part to our claims partners.

We may also charge you a fee for the arrangement and administration services provided, including the use of our technology. If a policy arrangement fee is charged, it will be set out on your Policy Schedule and is not refundable if the policy is cancelled outside of the cooling-off period.

How our employees are remunerated

Our employees get a fixed salary and participate in employee share options schemes. They may be eligible for an annual performance payment or retention incentives which are discretionary and based on reaching agreed performance levels.

Information you provide to us

We provide you with products and services based on the information you provide to us. The insurers we work with also provide the insurance products to you based on the information you provide.

If information you have given us is incorrect or misleading, we or the relevant insurer may need to:

  • change your premium or excess;
  • cancel your policy;
  • declare your policy as void, which means treating it as if it never existed; or
  • decline a claim or reduce the amount of your claim settlement.

You confirm that all information you provide to us in using the Website, Support Centre or our Services is accurate.

Intentionally providing us with false or misleading information may lead to termination or forfeiture of the product or service and may result in legal action.

We may terminate any services or products provided to you or others based upon your intentionally providing materially false information or acting under a false identity that you have supplied to us.

How we process your personal information

You can find a copy of our Privacy Policy on the Website. It contains important information about what personal data we collect and process, how it’s collected and processed, and your legal rights.

Using our Website and Support Centre

Use of our Website and Support Centre is for non-commercial, personal purposes only unless contractually agreed by us. You warrant that any quote made using this Website is made only for your own personal purposes of seeking to purchase the relevant insurance product, and not for any commercial purposes.

If we consider that you are using this website for commercial purposes, we may suspend or withdraw your access immediately and, if appropriate, pursue legal action against you.

We take all reasonable steps to ensure this Website and the App are available at all times we shall not accept any liability for any losses incurred as a result of this Website and / or the App being unavailable for any reason, at any time or for any period. We have the right to suspend access to the Website and / or the App and any services provided by us at any time and for any period. It may be necessary from time to time for us to suspend access to the Website and / or the App for routine maintenance or updates.

This website may contain links to third party websites. We do not make any representations as to the content of any third party websites.

Information we give is not advice

We take care to ensure that the information on our Website and Support Centre is accurate and up-to-date. However, you should not rely on the information for advice or as a recommendation that a particular product is suitable for your needs. If you need financial advice, you should contact a financial advisor.

We do not make any representations or warranties about the accuracy, completeness, reliability or suitability for any purpose of any information published on the Website or our Support Centre.

Your SO-SURE account and password

If you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us through our Support Centre.

You will be responsible for any losses you incur as a result of your failure to keep your username and password secure.

Intellectual property

All intellectual property on this website – including the SO-SURE trademarks and copyright in the information, text, graphics, services and other data – is owned by us or licensed by us and no part of this website may be reproduced, stored, modified, adapted, uploaded to another location or produced for display in any form without our prior written approval.

Limitation of liability

Neither we, our subcontractors, associates nor related companies or directors, shall be liable in any way for any loss or damage suffered by you through your use of the Website, Support Centre, or our Services, including but not limited to loss or damage arising in connection with:

  • your use of the Website, Support Centre, or the Services;
  • any defects, viruses and any other malfunctions caused to any equipment and other software;
  • the information provided on or through the Website, Support Centre or the Services;
  • the interception, modification or misuse of information transmitted to us or transmitted to you;
  • the functioning or non-availability of the Website, Support Centre or the Services;
  • the misuse of the Website, Support Centre or the Services;
  • claims by third parties in connection with the use of theWebsite, Support Centre or the Services;
  • any loss or unauthorised access to any data or information that you provide to us when using the Website, Support Centre or the Services;
  • any loss arising from unauthorised transactions arising from the use of your account with us.

This is a comprehensive limitation of liability that applies to all damage of any kind, including, without limitation, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and third party claims.

However, nothing shall exclude or restrict:

  • liability for death or personal injury resulting from the negligence of us, our directors, employees or agents; or
  • our obligations under the Financial Services and Markets Act 2000 or any other current or future financial services legislation.

Our liability for negligence, breach of contract or contravention of any Australian law as a result of our failure to provide the Service or any part of it, or for any problems associated with your use of the Service (including any loss of data or information you provide to us when using the Service), which cannot be lawfully excluded by Australian law, is limited, at our option and to the maximum extent permitted by Australian law, to resupplying the Service or any part of it to you, or to paying for the resupply of the Service or any part of it to you or paying you a maximum of £1,000.

Making changes

We reserve the right, at any time and without notice, to revise the contents of the Website or Support Centre, including these Terms & Conditions.

Any changes to these Terms & Conditions will be posted on the Website and by continuing to use the Website, Support Centre or our other Services, and / or the App you are agreeing to be bound by the revised Terms & Conditions.

Governing law

Unless we have agreed otherwise with you, any insurance contract written through us shall be subject to the laws of England and Wales and the courts of England and Wales shall have the exclusive jurisdiction.

Other

If any of these provisions shall be unlawful, void or for any purpose unenforceable, then the particular provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
